The ongoing debate regarding the proposed Kingdom Law for financial supervision has brought the concept of Aruba’s ‘status aparte’ back into public discourse. While one side argues that Aruba’s status aparte is in danger due to the Kingdom Law regarding financial supervision, the government side contradicts this, though it remains unclear if the indicated danger is justified.
From a technical perspective, experienced jurists note that the concept ‘status aparte’ arose as a slogan in the struggle for Aruba to abandon the ‘Netherlands Antilles’ and achieve a separate status as an autonomous country within the Kingdom of the Netherlands. While technically Aruba is another autonomous country within the Kingdom, it continues to represent the historic struggle and victory. Any person or entity speaking of ‘status aparte’ refers to something that requires no explanation for Arubans; it remains a symbol of the fervent struggle believed impossible in the 70s and 80s but achieved against all odds.
