ORANJESTAD (AAN) – Legal Experts Raise Concerns Over HOFA Constitutional Framework after two prominent constitutional law professors published a critical analysis of the advisory opinion issued by the Kingdom Council of State (Raad van State) regarding the proposed Consensus Kingdom Act HOFA.

According to Prof. Dr. Douwe Jan Elzinga and Prof. Dr. Hansko Broeksteeg, the Council of State’s advice lacks sufficient depth and does not adequately examine the constitutional implications, potential risks to Aruba’s autonomy, or the structural concerns associated with implementing HOFA through a Consensus Kingdom Act.

The professors argue that the advisory opinion fails to fully address important constitutional questions surrounding the proposed legislation.

Questions Over Aruba’s Autonomy

One of the principal concerns raised in the analysis is whether the agreement can truly be considered voluntary if Aruba cannot unilaterally withdraw from it and instead remains dependent on decisions made by the Kingdom Council of Ministers in The Hague.

According to the legal scholars, this raises important questions about the balance between financial cooperation and constitutional self-governance within the Kingdom of the Netherlands.

Concerns About Legislative Authority

The professors also expressed concern over the authority that HOFA would grant the Kingdom Council of Ministers to approve amendments to Aruba’s national legislation.

They argue that such an arrangement may not be compatible with Aruba’s existing constitutional framework and could limit the legislative authority of both the Government of Aruba and the Parliament of Aruba.

In addition, they questioned whether approval of the legislation should require only a simple parliamentary majority or whether a two-thirds majority would be constitutionally necessary.

Financial Benefits and Long-Term Oversight

While acknowledging that HOFA could provide Aruba with access to loans and refinancing under more favourable financial conditions, the professors questioned whether those economic advantages justify the potential reduction in constitutional autonomy and the uncertainty surrounding long-term financial supervision.

Under the proposed framework, Aruba would be permitted to request withdrawal from the legislation after meeting all required standards for at least three years. However, the scholars note that the final decision would not rest solely with Aruba, but would also depend on approval by Kingdom authorities.

Academic Analysis, Not Personal Criticism

The professors emphasized that their analysis, which was shared on LinkedIn, should not be interpreted as a personal attack on the Kingdom Council of State or as a complete rejection of its advisory opinion.

Instead, they said their criticism is directed primarily at what they consider to be insufficient constitutional analysis and the limited attention given to several important legal issues that could significantly affect Aruba’s governance and autonomy.
