In an Aruba immoral acts case prosecution, the Public Prosecutor has requested a combined sentence against a 44-year-old Colombian man living in Aruba who is accused of committing immoral acts involving his partner’s daughter.

During Thursday morning’s court hearing, the suspect denied all allegations. The prosecution requested a sentence of 180 days in prison, of which 75 days would be conditional, with a two-year probation period.

According to the charges, the alleged incident took place on February 6, 2025. The prosecution claims the suspect touched the young woman’s feet and intimate area and masturbated on the sheet covering her. In court, the suspect rejected the accusations and said he had done nothing wrong.

The judge reviewed statements indicating that the young woman had been sleeping on a sofa under a sheet when the alleged incident occurred. The suspect told the court that the accusation was a “set-up” and claimed that the young woman had previously threatened to cause him to lose his job.

The suspect also argued that the young woman has psychological problems and said she had made similar accusations before. He stated that on the day in question he was asleep and only woke up when police knocked on the door.

A major point in the case is that the Netherlands Forensic Institute (NFI) examined samples from the sheet and did not find sperm evidence. The judge noted that this appears to support the suspect’s denial that he masturbated. However, the prosecution argued that the absence of sperm does not automatically prove that the alleged victim’s account is false.

The prosecution said other supporting elements remain important, including the emotional state of the young woman shortly after the alleged incident. Police reportedly found her extremely distressed, and a friend also confirmed that she was very emotional when asking for help to go to the hospital.

The alleged victim later addressed the court and said she was frightened after seeing a shadow over her. She stated that she felt the suspect touching her feet and masturbating on the sheet covering her body. She also told the court that she suffered a panic attack and was deeply scared by the experience.

A request was also presented for 5,000 florins in non-material damages. However, the prosecutor said the claim could not yet be approved at this stage.

In the Aruba immoral acts case prosecution, the court has not yet delivered a final judgment. After hearing the defense, the judge announced that the case will be reviewed further and that a decision is expected on April 9, 2026.

Because the matter is still before the court, the allegations remain under judicial review until a final ruling is issued.
