ORANJESTAD, Aruba — The Flamingo Case Ruling has been postponed by more than two weeks, with Aruba’s Court of Appeal now scheduled to deliver its judgment on Thursday, September 17, 2026.
The ruling had originally been scheduled for Tuesday, September 1 at 1:30 p.m.
However, the Court informed the Prosecutor General and attorneys representing Oduber, Esser and Wever that it would not be able to issue its judgment on the previously announced date.
The new hearing is scheduled for September 17 at 1:30 p.m. at the Court of Justice building in Aruba.
Flamingo Case Ruling Delayed by Court
The Flamingo Case Ruling follows appeal proceedings involving former minister Otmar Oduber and co-defendants Esser and Wever.
The appeal hearings concluded in early June, after which September 1 was selected as the expected judgment date.
Days before that scheduled hearing, however, the parties were notified that the three-judge panel had not completed the ruling.
The Court has not publicly provided further details explaining why additional time is required.
Current reporting confirms that September 17 has now been formally selected as the new judgment date.
Appeal Proceedings Held in June
The Flamingo case concerns allegations connected to government land allocation, public-sector appointments and abuse of public office during Oduber’s period as a minister.
During the June appeal proceedings, the Public Prosecutor’s Office argued that the first-instance outcome did not sufficiently reflect the seriousness of the alleged conduct.
Prosecutors asked the Court of Appeal to impose a three-year unconditional prison sentence on Oduber.
They also requested restrictions preventing him from holding public office or exercising passive voting rights for six years.
Oduber’s defense has challenged the prosecution’s case and requested acquittal.
Esser and Wever Also Await Judgment
The appeal also involves Esser and Wever.
Esser was acquitted of charges at first instance, but the Public Prosecutor’s Office appealed that outcome.
During the appeal, prosecutors sought a prison sentence against her.
Wever was convicted at first instance in connection with allegations involving government land procedures and official documents.
Her defense has argued that she acted under instructions from superiors and has asked the appeal court to overturn the conviction.
The Court’s September 17 judgment will determine how it assesses the cases against all three defendants.

The Flamingo Case Ruling is now expected at 1:30 p.m. on Thursday, September 17, 2026.
Until the Court issues that decision, the existing first-instance judgments remain the latest judicial outcomes in the case.
The appeal court may uphold, overturn or modify aspects of those rulings depending on its assessment of the evidence, legal arguments and appeals submitted by prosecutors and the defendants.
The September 17 hearing is therefore expected to mark the next major legal development in the long-running Flamingo case.
