Commission 11 Receives CAPA Membership Register After Over a Year of Struggle

After nearly a year and a half of persistent efforts, Commission 11 is set to receive the membership register of CAPA at 11:00 AM today.

This long fight was sparked by the need for clarity regarding a 382,000 Florin fraud incident.

Initially, Commission 11 tried to resolve the issue through compromise with the CAPA board, sending letters requesting more information about the fraud. As a member of CAPA, Commission 11 requested a meeting with the board, but all responses from the board were negative, and they ignored the request for a meeting. The board instead sought confrontation with Commission 11. This led Commission 11 to escalate the issue, ultimately leading to the board’s decision to hand over the membership register.

Controversial statements: On September 12, Commission 11 received an email from Mr. Duijneveld, representing CAPA’s board, stating that at 11:00 AM on the same day, Commission 11 would receive the membership register.

Strangely, Mr. Duijneveld later claimed that CAPA’s board had not appealed the case against Commission 11 (which CAPA members won). However, shortly after, he sent a letter via courier indicating that the board would indeed appeal the case.

Last week, the President of CAPA informed Commission 11 by phone that CAPA had appealed the judge’s decision in favor of Commission 11. Commission 11 presented evidence showing that CAPA’s board had not actually appealed the case. This revealed the dysfunction and incompetence of CAPA’s leadership.

Furthermore, Mr. Duijneveld stated that CAPA’s board disagreed with the judge’s decision. Is that so?

In the old statutes, Article 30 and the new statutes (presented about a year ago by the current board) refer to Article 34, which states that after payment, members are entitled to receive the register. This is in accordance with the law regarding the operation of cooperatives in Aruba, AB 1987, and Article 11, part 3, which aligns with CAPA’s statutes. The judge’s verdict was in line with the law and CAPA’s regulations.

Despite this, CAPA’s board still disagrees. Well, the board members should not remain members of our cooperative, CAPA.

Given their anti-cooperative stance, it might be better for them to withdraw from CAPA.

Final thoughts: To make it clear to everyone, Commission 11’s struggle is about obtaining clarity regarding the 382,000 Florin fraud incident, which has been a matter of concern for 9 months.
