A DOW tree complaint was largely upheld by Aruba’s Ombudsman following concerns about the department’s handling of a resident’s reports, according to 24ora’s October 20 account.
Communication and assessment found insufficient
The resident had contacted DOW repeatedly since August 2022 about a nearby kwihi tree, reporting branches over the home, root-related damage and damage during pruning. These are the resident’s reported concerns, not an independent finding here about the cause of property damage.
The Ombudsman found communication and information insufficient. The case file also did not adequately show a transparent investigation and assessment of the resident’s particular circumstances and interests, the report said.
New inspection and clearer procedures recommended
The recommendations call for another site inspection with an opportunity for the resident to explain the concerns, followed by an assessment of appropriate maintenance or other measures. DOW was also asked to publish accessible policy and assessment criteria for maintaining and removing trees and plants not protected by law.
The department should explain how complaints will receive timely answers, a clear contact point and progress information. The ministry responsible and DOW were asked to inform the Ombudsman within six weeks about measures taken or planned.
The Ombudsman did not decide that the kwihi tree must be removed. The report does not confirm implementation of the recommendations.
