The Government Employees Court has ruled in favor of Immigration Director Andrew Hoo, concluding that the Minister of Justice acted unreasonably and unlawfully in ordering his reassignment to another department.
Mr. Hoo, represented by attorney Mr. Steward, filed the case following a decision issued by the Minister on October 21, 2025, which required him to transfer to a different department. The Minister, represented by Mr. Pieters, stated that the decision was based on a lack of confidence in Hoo.
Court’s Evaluation
In its ruling, the judge determined that the Minister’s decision stemmed from dissatisfaction with Hoo’s response to a request for passenger information extracted from the RADEX system, as well as documentation related to denied entries, detention orders, and deportations.
Hoo formally responded to the Minister, requesting clarification on which specific data was required, citing concerns over personal data protection and passenger privacy, given the sensitive nature of the information stored in RADEX. He emphasized that privacy laws must be respected and that requests should clearly state purpose and scope.
Disciplinary Measures Challenged
Following this exchange, the Minister concluded that trust in Hoo had been lost and ordered his reassignment to the Police Department, specifically to a unit handling the new driver’s license system, for a period of six months. The Minister also questioned Hoo’s tone in internal WhatsApp communications and accused him of placing conditions on ministerial authority.
Additionally, the Minister raised concerns regarding exemption letters previously signed by Hoo and a former Minister, alleging a lack of authorization.
Judge Finds No Grounds for Distrust
The judge rejected the Minister’s claims, stating that Hoo showed no disrespect and did not undermine ministerial authority. The court noted that Hoo was summoned to meetings without being informed of the topics beforehand, leaving him unprepared for the accusations raised.
The judge concluded that there was no legitimate basis for distrust, criticized the Minister for failing to follow the principle of due inquiry before making such a decision, and described the action as irresponsible.
Hoo to Resume His Position
As a result, the court suspended the Minister’s decision and ordered that Andrew Hoo resume his duties as Director of Immigration effective December 15, 2025.
