The court has sentenced a massage therapist, identified as C., to three years in prison for sexually assaulting a female client, referred to as M., during a massage session on April 16, 2025. In addition, the court imposed a five-year ban preventing him from practicing as a massage therapist.
During the court proceedings last month, C. admitted to abusing the woman while performing the massage. The judge determined that he had violated the trust placed in him by his client and that his actions legally constituted rape under Aruba’s criminal code.
According to the court, the victim testified that C. unexpectedly inserted his finger into her private area during the session, leaving her shocked and unable to react. The judge emphasized that at no point did the victim give C. any form of consent.
Although the incident did not involve physical aggression, the court considered it a serious offense. Based on legal precedent, the judge imposed a reduced sentence due to the absence of additional violence.
The final judgment includes:
- Three years in prison, with one year suspended and two years of probation.
- A five-year ban on working as a massage therapist.
- Payment of 5,000 Florin to the victim for emotional damages.
The court dismissed the victim’s request for 35,000 Florin in non-material damages as insufficiently substantiated but ruled that she was entitled to compensation for emotional suffering. If C. fails to pay the ordered amount, he will serve an additional 60 days in jail.
