A 16-year-old male from Colombia, living in Aruba, was declared innocent in court after being accused of sexual abuse against a female minor. The judge found there was insufficient evidence to support the accusations, and as a result, the charges were dismissed.

The charges stemmed from an alleged incident that occurred on October 19, 2024, when the 16-year-old, referred to as R., was accused of engaging in immoral acts with E., a fellow student. However, there was no supporting evidence from the victim’s testimony, and key parties did not show up in court.

Court Ruling and Decision

In the case, the victim, E., initially reported the incident to the police, claiming she had been sexually assaulted after drinking Four Loko on the beach with R. However, R. argued the encounter was consensual. He testified that E. had initiated the alcohol consumption and sexual activity.

After reviewing the case, the judge ruled that there was insufficient proof to support E.‘s claims of sexual abuse. No medical or psychological reports substantiated the victim’s allegations. As a result, the court declared the 16-year-old abuse innocent.

Defense Argument

Defense attorney Mr. Hernandez argued that the victim had fabricated the story and pointed out inconsistencies in her account. The defense also highlighted the lack of medical evidence and the deletion of important messages from R.‘s phone by E.‘s guardian.

Legal Outcome

The judge’s decision to declare the 16-year-old abuse innocent emphasized the importance of strong, corroborative evidence in such sensitive cases. The ruling raised questions about how these cases are handled when conflicting testimonies exist without clear supporting evidence.

This case reflects the challenges in legal proceedings where sexual abuse allegations must meet a high standard of proof.
