The Malmok fatal crash case involving a 2024 Nissan Skyline collision has been adjourned again while Aruba’s court seeks more clarity about whether a mechanical failure contributed to the crash.
Crash killed Dariana Heredia Perez
Diario reported that the case concerns a July 2024 crash near the end of Malmokweg toward Westpunt. The Nissan Skyline overturned and split apart near Tierra del Sol, and passenger Dariana Heredia Perez died.
The prosecution has argued that driver N.T. was travelling at more than 150 kilometres per hour and acted irresponsibly. It previously sought a six-month prison sentence, a two-year driving ban and confiscation of the vehicle.
Defence points to possible mechanical failure
Defence lawyer Edwards has argued that a mechanical problem prevented N.T. from controlling or stopping the car. The earlier judge ordered more investigation into the throttle body after finding that the technical evidence was incomplete.
The Netherlands Forensic Institute later indicated that it could not perform the requested investigation because of the time involved and uncertainty about obtaining a result for the Japanese vehicle, according to the source.
Court seeks further clarity before deciding
A new judge took over after the previous judge returned to the Netherlands. At the latest hearing, the prosecutor asked for additional investigation into whether vehicle-computer data could clarify the throttle-body issue and whether the reported speed could have caused another mechanical problem.
The judge concluded that more clarity was still needed before a decision could be made. The case was adjourned indefinitely, extending proceedings that have remained unresolved for more than two years after the fatal crash.
