Court finds attempted murder proven
An Aruba judge found a 79-year-old man identified as E.D. guilty of attempted murder for stabbing another man twice on February 9, 2024. The court rejected a defence claim that he acted to protect his son. Although the judge did not find direct intent to kill, the ruling said using the knife meant accepting the risk of death.
Health affected the custodial penalty
Prosecutors sought two years in prison while acknowledging the defendant’s age and health. The court cited a doctor’s letter stating his condition had worsened and did not permit imprisonment at KIA. He had suffered a heart attack, experienced depression and cared for his bedridden wife, according to the court account.
Compensation ordered for lost income
The Aruba court sentence was 365 days, with 331 days suspended and two years of probation, so the defendant does not immediately return to prison. The court also ordered Afl. 15,337 for the victim’s lost earnings after surgery, while rejecting a separate eyeglasses claim.
